When families are dealing with the emotional trauma of losing a loved one, facing the prospect of understanding how that loved one’s estate must be handled can be overwhelming. Davis, Agnor, Rapaport & Skalny, LLC has an entire practice group dedicated to helping families with the legal matters surrounding probate and trust administration.
Probate is the process the government uses to ensure that the creditors and beneficiaries are handled properly. Creditors are paid and then the personal representative (executor) is authorized to take whatever action is necessary to transfer property from the decedent to the decedent's beneficiaries. All of this is done through the probate process.
DARS understands that the nature and issues involved in each probate or trust estate are as unique as each individual. Our attorneys are prepared to explain to each client, in plain English, all of the steps needed to wind-up a loved one’s affairs, and then to work with the individual or family to meet this goal. With the introduction of revocable living trusts, various tax-planning trusts, supplemental needs trusts, and children’s trusts of diverse types into the probate estate process, there is a growing need for effective guidance to trustees regarding the administration of these trusts. Our Probate & Trust Administration Group will guide clients smoothly through these issues, ensuring that all probate and trust administration is completed efficiently and appropriately.
